4. SMS and mobile messaging
OFFERLETR uses SMS as a primary communication channel through Oshun, our AI career companion. This section describes how SMS data is handled.
4.1 Opt-in and consent
You opt in to receive SMS messages from OFFERLETR by texting our designated keyword to our short code and replying affirmatively to our consent message. Before any SMS communication beyond the initial consent exchange, you will be presented with the following disclosures:
- The identity of the message sender (OFFERLETR / InsightGap, LLC)
- The categories of messages you will receive (career verification, job matching, shift updates, account alerts, and career intelligence)
- Message frequency disclosure
- Notice that message and data rates may apply
- Instructions to reply STOP to opt out and HELP for support
- Links to this Privacy Policy and our Terms of Service
Your affirmative reply is recorded as an immutable consent record, including the exact language presented to you, your exact response, the timestamp, and the channel.
4.2 SMS data protection
We will not sell, rent, loan, trade, lease, or otherwise distribute your mobile phone number or any SMS opt-in information to any third party for marketing or promotional purposes. Your phone number and SMS opt-in data are used solely to deliver the OFFERLETR services you have consented to receive.
SMS opt-in information is not shared with third parties or affiliates for their own marketing purposes. SMS opt-in data is not used for any purpose other than providing the services described in this Privacy Policy and your opt-in disclosure.
4.3 Opt-out
You may opt out of SMS messages at any time by replying STOP to any message from OFFERLETR. Upon receiving a STOP request, we will confirm your opt-out and cease all SMS communications within 24 hours. Opting out of SMS does not delete your account or your data; it disables the SMS communication channel. You may continue to use the web-based DASH and manage your profile through offerletr.com. You may opt back in at any time by texting our keyword again and completing the consent flow.
4.4 Message content and storage
SMS conversations with Oshun are stored as part of your account record. Message content may include professional profile data, career guidance, interview preparation materials, salary intelligence, shift assignments, and verification status updates. These messages are retained for as long as your account is active or as required to maintain your consent records (see Section 10). We do not use SMS message content for advertising or sell it to third parties.
5. Consent management and data sharing
Consent is a foundational principle of the OFFERLETR platform. We do not share your personal information with employers, recruiters, or any third party without your explicit, informed, and revocable consent, except as described in this policy.
5.1 How consent works on OFFERLETR
Every data-sharing event on OFFERLETR is governed by a consent record. When an employer or recruiter requests access to your profile, you will receive a notification (via SMS, in-app, or both) describing exactly what information will be shared and with whom. You may approve or decline each request individually. Every consent record captures:
- The identity of the requesting party (employer name, recruiter name, company)
- The specific data scope authorized (which profile sections will be visible)
- The exact authorization language presented to you
- Your response (approved or declined)
- The timestamp and channel of your response
- The specific job or engagement the consent pertains to
Consent is always job-scoped, meaning consent to share your profile for one role does not authorize sharing for any other role or purpose. You may revoke consent at any time through the Consent tab in your DASH or by notifying Oshun.
5.2 Data shared with employers and recruiters
When you consent to share your profile with an employer or recruiter for a specific role, the following information may be made available:
- Your name and contact information
- Your verified capability statements, including evidence summaries, proficiency tiers, and peer attestation summaries
- Your role history, industry, and years of experience
- Verified certifications and credential status
- Salary positioning data from your Salary Power Panel (if you authorize this separately)
- Languages spoken
- General location (metro area)
Before you consent, employers and recruiters may see only anonymized match data: match percentage, skill category tags, proficiency tier distribution, verification badge counts, and general metro area. They cannot see your name, specific capability statement details, portfolio artifacts, attestation content, contact information, or salary data until you explicitly consent.
5.3 Data shared with InsightGap service verification partners
For service verification deployments (such as hospitality staffing engagements), when you consent to participate and a service partner (such as a restaurant owner or venue operator) selects you for a shift, the following data may be shared through our API:
| Data field | Purpose |
|---|---|
| Worker ID | Unique platform identifier for matching and assignment |
| First and last name | Identity confirmation for the service partner |
| Phone number | Direct communication for shift coordination |
| Roles (e.g., Bartender, Server, Line Cook) | Role matching and assignment |
| Verification status | Confirms that your credentials have been authenticated |
| Queue status | Indicates your current availability for shift assignment |
| Certifications and expiration dates | Confirms current, valid credentials for the role |
| Years of experience | Informs role suitability and assignment decisions |
| Languages | Supports communication and customer service matching |
| General location, ZIP code, latitude, and longitude | Proximity matching for shift assignments |
| Weekly availability and shift windows | Scheduling and shift assignment |
| Consent token status | Confirms that you have authorized this data sharing |
| Verification timestamps | Provides audit trail for when credentials were last verified |
This data is shared only after you have consented to participate in the service verification deployment and is used solely for the purpose of matching you to available shifts and enabling the service partner to confirm your qualifications. Service partners are contractually prohibited from using this data for any purpose beyond the specific engagement.
5.4 What we do not share
Regardless of consent status, we never share the following with any third party:
- Your SMS message history or conversation content with Oshun
- Your raw application tracking data or behavioral signals
- Your Purpose Pulse score or internal alignment metrics
- Your Negotiation Simulator session data or strategy inputs
- The specific methods, algorithms, or technical processes used to verify your credentials
6. Data shared with third-party service providers
We use third-party service providers to operate the platform. These providers process data on our behalf under contractual obligations to protect your information and use it only for the purposes we specify.
- Cloud infrastructure providers for data storage and computing
- SMS and messaging service providers (for delivering Oshun messages)
- Payment processors (if applicable for premium features)
- Analytics providers (using de-identified, aggregated data only)
We do not sell your personal information to any third party. We do not share your personal information with third parties for their own marketing or advertising purposes.
7. Legal bases and lawful disclosures
We may disclose your information without your consent only when required by law, including:
- In response to a valid subpoena, court order, or government investigation
- To comply with applicable federal, state, or local law or regulation
- To protect the rights, safety, or property of OFFERLETR, our users, or the public
- In connection with a merger, acquisition, or sale of assets (in which case your data would remain subject to this policy or a successor policy with equivalent protections, and you would be notified)
If we receive a law enforcement request for your data, we will notify you unless we are legally prohibited from doing so.
8. Artificial intelligence and automated processing
OFFERLETR uses artificial intelligence to power several platform features, including Oshun (career intelligence and conversational onboarding), credential verification and authenticity detection, capability matching and job title compatibility analysis, salary positioning and market intelligence, and Purpose Pulse behavioral signal analysis.
8.1 How AI processes your data
When you interact with Oshun or use AI-powered features, your inputs (messages, uploaded documents, profile data) are processed by our AI systems to generate responses, verify credentials, and provide career intelligence. AI processing occurs in real time for conversational features and in batch for verification and matching.
8.2 Human oversight
Automated decisions that materially affect your access to opportunities (such as verification status determinations or authenticity flags) are subject to human review upon your request. You may request review of any automated determination by contacting support@offerletr.com or by asking Oshun.
8.3 AI training and improvement
We may use de-identified, aggregated interaction data to improve our AI models and platform features. We do not use your individually identifiable SMS messages, capability statement content, or uploaded documents to train AI models without your explicit consent. If we seek to use identifiable data for model improvement, we will present a separate consent request with a clear description of the data involved and your right to decline.
9. Data security
We implement administrative, technical, and physical safeguards to protect your personal information, including encryption of data in transit and at rest, access controls limiting data access to authorized personnel, immutable audit logs for all consent events and verification activities, and regular security assessments. While we take reasonable measures to protect your data, no system is completely secure, and we cannot guarantee absolute security.
10. Data retention
We retain your personal information for as long as your account is active or as needed to provide you with our services. Specific retention periods:
- Account and profile data: retained for as long as your account is active. Upon account deletion, profile data is removed within 30 days, except as required for legal compliance.
- Consent records: retained for a minimum of seven (7) years after the consent event, or longer if required by applicable law. This includes the exact language presented, your response, the timestamp, and the channel. Consent records are maintained even after account deletion to satisfy legal and regulatory obligations.
- Verification records: retained for a minimum of seven (7) years after the verification event to support audit trail integrity and compliance requirements.
- SMS message content: retained for as long as your account is active. Upon account deletion or SMS opt-out, message content is deleted within 90 days, except for consent records (which follow the consent retention schedule above).
- Behavioral and usage data: retained in identified form for up to 24 months, after which it is de-identified and aggregated.
- Capability statements and Skills Wallet data: retained for as long as your account is active. Upon account deletion, this data is removed within 30 days unless a consent-authorized sharing event requires longer retention for audit purposes.
11. Your rights and choices
Depending on your jurisdiction, you may have the following rights regarding your personal information:
Access and portability
You may request a copy of the personal information we hold about you, including your Skills Wallet, capability statements, consent records, and verification history. We will provide this in a structured, commonly used, machine-readable format upon request.
Correction
You may update or correct your personal information at any time through the DASH or by contacting Oshun. Corrections to verified capability statements may require re-verification.
Deletion
You may request deletion of your account and personal information. We will comply within 30 days, subject to retention obligations for consent records and verification audit trails as described in Section 10. Deletion of your OFFERLETR account will revoke all active consents and notify any employers or partners who were authorized to view your profile.
Consent withdrawal
You may revoke any consent at any time through the Consent tab in your DASH, by texting STOP (for SMS consent), or by contacting us. Consent withdrawal is prospective; it does not affect the lawfulness of processing based on consent given before withdrawal.
Opt-out of SMS
Reply STOP to any OFFERLETR SMS message, or manage your communication preferences in the DASH. See Section 4.3 for details.
Do not sell or share
We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising. If applicable law requires us to honor “Do Not Sell or Share” requests, you may submit such a request at privacy@offerletr.com.
To exercise any of these rights, contact us at privacy@offerletr.com. We will respond within 30 days (or within the timeframe required by applicable law). We will not discriminate against you for exercising any of these rights.
12. Fair Credit Reporting Act (FCRA) notice
Certain verification and background screening activities conducted through the OFFERLETR platform may be subject to the Fair Credit Reporting Act. When FCRA applies:
- You will receive a standalone, clear, and conspicuous disclosure that a consumer report may be obtained, separate from all other disclosures
- You will be asked to provide written authorization before any consumer report is procured
- If any adverse action is taken based in whole or in part on information in a consumer report, you will receive pre-adverse action notice (including a copy of the report and a summary of your rights) and subsequent adverse action notice
FCRA-related consents are tracked separately from general profile-sharing consents in your Consent tab. You may view, manage, and dispute any FCRA-related activity through the DASH or by contacting us directly.
13. Children’s privacy
OFFERLETR is not intended for use by individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will delete that information promptly. If you believe a child under 16 has provided us with personal information, please contact us at info@offerletr.com.
14. State-specific disclosures

If you are a California resident, you have the right to know what personal information we collect, use, disclose, and sell (we do not sell personal information); the right to delete personal information we hold about you; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information (not applicable, as we do not sell or share for advertising); and the right to non-discrimination for exercising your rights. To exercise these rights, contact privacy@offerletr.com or use the mechanisms described in Section 11.
14.2 Other state privacy laws
If you are a resident of Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, or another state with an applicable consumer privacy law, you may have similar rights to access, correct, delete, and port your data, and to opt out of targeted advertising, profiling, and sale of personal information. Contact info@offerletr.com to exercise these rights.
15. International users
OFFERLETR is operated in the United States. If you access the platform from outside the United States, your information will be transferred to and processed in the United States. By using the platform, you consent to this transfer. If you are located in a jurisdiction that requires specific legal bases for processing (such as the European Economic Area), we process your data based on your consent (for SMS, profile sharing, and voluntary data provision), contractual necessity (to provide the services you requested), legitimate interests (for platform security, fraud prevention, and service improvement), and legal obligation (for retention of consent and verification records).
16. Changes to this policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the DASH, via Oshun (SMS or web chat), or by email at least 30 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated policy. We will not reduce your rights under this policy without your explicit consent.
